City Manager Letter

In order to provide the City Council with preliminary information regarding any disposition of the Foundry Building, in relation to tonight's Council Order, and renewed private interest in utilizing the property on a short and long term basis, I submit the following:

Chapter 30B, Section of the Massachusetts General Laws proscribes the legal requirements for sale or rental of Public Property (copy attached).

City Ordinance 2.110.010 provides significant additional local requirements for real property disposition (copy attached).  If it were the City Council's desire to "diminish" those requirements to entertain bids for a short term lease, in the order of 6 months with 2 or 3 six month options to renew, I would appreciate the Council so informing me.

At the Government Operations Committee meeting on October 19, 2012, it was my belief that the majority of the members of the City Council favored embarking on a process to sell the building with the proceeds going to the "Community Benefits Fund."  If that position has been changed, and the City Council wishes to pursue the "Short-Term Lease Model," it would be helpful if that were done with a formal vote, including diminution of the process, if that is the City Council's desire.
