The Owner and Contractor agree as follows:
Article 1 - The Contract Documents
The Contractor shall complete the Work described in the Contract Documents for the project.
The Contract Documents shall consist of:
1.1 This agreement signed by the Owner and Contractor;
1.2 Email Correspondence to date XXX
1.3 written change orders or orders for changes in the Work issued after execution
of this Agreement
Article 2 - Date of Commencement and Substantial Completion
The date of commencement shall be at least 30 days prior to opening (Falll 2022) or sooner
Article 3 - Contract Sum
3.1 This will be a Lump Sum Contract of $21,500.00 for the following work:
-Signage, Awnings and Install per approved plans incl Permit
3.2 For purposes of payment, the Contract Sum includes the following values related to portions
of the Work:
-Labor will be billed at $40/hr and Carpentry will be billed at $60/hr
-Supervision, Overhead and Profit will be invoiced at 20% of subcontractor costs,
including materials.
-Permit will be obtained for above listed work for $250 + actual cost of permit
3.3 The Contract Sum shall include all items and services necessary for the proper execution and
completion of the Work. Costs will be estimated and agreed to in writing before proceeding.
Article 4 - Payment
4.1 Based on Contractor's Invoices, the Owner shall pay the Contractor as follows:
- 50% Due to Start Fabrication
- Final payment is due within 30days of Substantial Completion.
Article 5 - Insurance
5.1 The Contractor shall provide Contractor's Liability and other Insurance as follows prior to
commencement of the Work:
Limit $1,000,000.00 per occurrence
General Liability
Limit $100,000.00 per occurrence
Workmans Compensation
Article 6 - Additional work required due to unforeseen conditions or additional items required
by the City or Owner and not specifically called out in the breakdown will be discussed with and
approved by the Owner prior to proceeding and billing as extras per the terms outlined above.
Article 7 - The Contractor shall be responsible for initiating, maintaining and supervising all
safety precautions and programs, including all those required by law in connection with
performance of the Contract. The Contractor shall take reasonable precautions to prevent
damage, injury or loss to employees on the Work, the Work and materials and equipment to be
incorporated therein, and other property at the site or adjacent thereto. The Contractor shall
promptly remedy damage and loss to property caused in whole or in part by the Contractor, or by
anyone for whose acts the Contractor may be liable.

This agreement is made on 5/2/22 between the Owner: PF Supreme and the Contractor:
PointsNorth Construction Management L.LC. for the following Project: Signage @ Mass Ave.
The Architect/Engineer is NA
The Owner and Contractor agree as follows:
Article 1 - The Contract Documents
The Contractor shall complete the Work described in the Contract Documents for the project.
The Contract Documents shall consist of:
1.1 This agreement signed by the Owner and Contractor;
1.2 Email Correspondence to date XXX
1.3 written change orders or orders for changes in the Work issued after execution
of this Agreement
Article 2 - Date of Commencement and Substantial Completion
The date of commencement shall be at least 30 days prior to opening (Falll 2022) or sooner
Article 3 - Contract Sum
3.1 This will be a Lump Sum Contract of $21,500.00 for the following work:
-Signage, Awnings and Install per approved plans incl Permit
3.2 For purposes of payment, the Contract Sum includes the following values related to portions
of the Work:
-Labor will be billed at $40/hr and Carpentry will be billed at $60/hr
-Supervision, Overhead and Profit will be invoiced at 20% of subcontractor costs,
including materials.
-Permit will be obtained for above listed work for $250 + actual cost of permit
3.3 The Contract Sum shall include all items and services necessary for the proper execution and
completion of the Work. Costs will be estimated and agreed to in writing before proceeding.
Article 4 - Payment
4.1 Based on Contractor's Invoices, the Owner shall pay the Contractor as follows:
- 50% Due to Start Fabrication
- Final payment is due within 30days of Substantial Completion.
Article 5 - Insurance
5.1 The Contractor shall provide Contractor's Liability and other Insurance as follows prior to
commencement of the Work:
Limit $1,000,000.00 per occurrence
General Liability
Workmans Compensation
Limit $100,000.00 per occurrence
Article 6 - Additional work required due to unforeseen conditions or additional items required
by the City or Owner and not specifically called out in the breakdown will be discussed with and
approved by the Owner prior to proceeding and billing as extras per the terms outlined above.
Article 7 - The Contractor shall be responsible for initiating, maintaining and supervising all
safety precautions and programs, including all those required by law in connection with
performance of the Contract. The Contractor shall take reasonable precautions to prevent
damage, injury or loss to employees on the Work, the Work and materials and equipment to be
incorporated therein, and other property at the site or adjacent thereto. The Contractor shall
promptly remedy damage and loss to property caused in whole or in part by the Contractor, or by
anyone for whose acts the Contractor may be liable.
