LEASE AGREEMENT
THIS LEASE AGREEMENT ("Lease") is made and entered into as of this 11th day of
between U.S. REIF CENTRAL PLAZA
2021 ("Effective Date")
MASSACHUSETTS, LLC, a Massachusetts limited liability company ("Landlord"), and
TASTY BURGER
CENTRAL SQUARE, LLC, a Massachusetts limited liability company
("Tenant").
Intending to be legally bound, Landlord and Tenant agree as set forth below.
PREMISES. Landlord hereby leases to Tenant and Tenant hereby leases from Landlord, for the
erm and subject to and with the benefit of the terms, covenants, conditions and provisions hereo
premises consisting of approximately 4,669 rentable square feet of space located on the first (1st) floo
("First Floor Premises"), and approximately 1,500 square feet of outdoor area (the "Outdoor Area")
(all of which is more particularly shown on Exhibit "A", collectively, the "Premises") at the property
known as Central Plaza I (the "Building") erected on certain land (the "Land" located at 675
Massachusetts Avenue, Cambridge, Massachusetts (collectively, the Premises, Building, and Land shall
be known as the "Property"). For purposes of this Lease, Tenant's proportionate share (Tenant's
Proportionate Share") shall be deemed to be 3.77% which is based on 4,669 rentable square feet in the
First Floor Premises divided by 123,810 rentable square feet in the Building. Tenant acknowledges and
accepts the rentable square feet as set forth in this Lease and Tenant shall not have the right to demand re-
measurement or recalculation of the rentable square feet with respect to the Premises or Building.
LEASE TERM. The term of the Lease (the "Lease Term") shall commence on the Effective
Date (the "Commencement Date") and shall expire on the last day of the full one hundred eightieth
(180"h) month following the Lease Commencement Date (the "Expiration Date"). Notwithstanding the
foregoing, if the Commencement Date occurs on a date that is other than the first or last day of a calendar
month, then the first (1) Lease Year shall mean the period from the Commencement Date to the date
which is the last day of full twelfth (12"') month following the Commencement Date.
3. FIXED RENT. INTENTIONALLY DELTED.
4. PERCENTAGE RENT.
Payment of Percentage Rent. Beginning on the earlier of: (a) three hundred sixty 360)
days following the receipt of all permits necessary to operate for the Permitted Use (as further described
in Section 6.2); or (b) the date upon which Tenant opens for business to the public (the "Rent
Commencement Date"), Tenant shall pay Percentage Rent as defined below, without prior notice or
demand, and without any setoff or deduction whatsoever, in advance, on the first day of each month at
Date, Rent Commencement Date, Expiration Date, and schedule with respect to Fixed Rent (as defined in
Section 3) by executing a Commencement Date Certificate in the form attached hereto as Exhibit "C". In
the event Tenant fails to execute and return the Commencement Date Certificate within ten (10) Business
Days (as hereinafter defined) of delivery from Landlord, Tenant shall be deemed to have accepted the
Commencement Date Certificate including the terms designated by Landlord therein.
