On September 23, 2021, Petitioner's architect Lewis Colten appeared before the Board of Zoning
Appeal requesting a special permit in order to install a second curb cut to accommodate a
parking spot. The Petitioner requested relief under Article 6, Section 6.43.5.B&C and Article 10,
Section 10.40 of the Cambridge Zoning Ordinance ("Ordinance"). The Petitioner submitted
materials in support of the application including information about the project, plans, and
photographs.
Mr. Colten stated that as part of a renovation of a two-family house, the petitioner was required
to provide a parking spot for each unit. He stated that there already was a curb cut and one
parking space on the west side, but there was not room for another parking spot there. He stated
that there was a curb cut already on the east side, too, but it was 6' and needs to be extended by
4' to accommodate a parking spot. He stated that this would require the special permit to enlarge
the east curb cut and driveway. He stated that he had the support of the immediate neighbors.
The abutting neighbor asked that the fence separating his property from the proposed driveway
be replaced after having been removed. The Chair noted letters in support and in opposition.
After discussion, the Chair moved that the Board make the following findings based upon the
application materials submitted and all evidence before the Board and that based upon the
findings the Board grant the requested relief as described in the Petitioner's submitted materials
and the evidence before the Board: that the Board find that the requirements of the Ordinance
could not be met without the special permit; that the Board find that traffic generated or patterns
of access or egress resulting from what was proposed would not cause congestion, hazard, or
substantial change in established neighborhood character; that the Board find that the continued
operation of or development of adjacent uses, as permitted in the Ordinance, would not be
adversely affected by the nature of the curb cuts proposed; that the Board find that no nuisance
or hazard would be created to the detriment of the health, safety and/or welfare of the occupant
of the proposed use, or the citizens of the City; that the Board find that, generally, what was
proposed would not impair the integrity of the district or adjoining district, or otherwise derogate
from the intent and purpose of the Ordinance.
The Chair further moved that based upon all the information presented the Board grant the
requested relief as described in the Petitioner's submitted materials and the evidence before the
Board on the following conditions:
1. that the work proceed in accordance with the plans submitted by the petitioner, being a
certified plot plan, as initialed by the Chair at the September 23, 2021 hearing,
2. that the hardscaped area directly in front of the bay window, as marked up on the plot plan, be
removed and replaced with a landscaped area, which must be maintained, and that this work be
completed prior to the cutting of the curb,
3. that the fencing be restored and maintained in order to separate the property from the
neighbor's,
4. that the end of the driveway be set where the porch meets the house and that the new
landscape come over from that point onwards so that the parking not be continued to the side of
the house.
The five-member Board voted unanimously in favor of granting the special permit with the
above conditions (Alexander, Sullivan, Hickey, Monteverde and Leiserson). Therefore, the
special permit is granted as conditioned.
The Board of Zoning Appeal is empowered to waive local zoning regulations only. This
decision therefore does not relieve the petitioner in any way from the duty to comply with local
ordinances and regulations of the other local agencies, including, but not limited to the Historical
Commission, License Commission and/or compliance with requirements pursuant to the
Building Code and other applicable codes.

Based on our conversations with the building commissioner and on his advice, we have
made adjustments to the previously submitted plot plan for parking identification and have
filed a revised plot plan in the portal.
We are applying for a curb cut extension on the east side of our building. There presently
exists a shared driveway for which 6 feet is on our property. We are requesting an
additional 4 foot extension in order that we may properly have the ability for a required
parking space on that side of the building.
Because this is a two-unit condominium, an additional required parking space is necessary.
This space is already available to us on the west side for which there is a shared curb cut for
us and our abutter.
In essence, the sole purpose for our going before the BZA is for an additional 4 feet to an
existing curb cut as noted on the submitted revised Certified Plot Plan.

Dear Neighborhood Representative:
This office is in receipt of a copy of an application from:
Lewis Colten for a Curb Cut at the location of 318 Concord Avenue with a Frontage of 45', Setback 11', Distance from
surrounding structures 6.4', Length 10.92', Width 10.5' and a total Square Footage of 114.66.
The City Council has directed that all curb cut petitions be submitted to the appropriate Neighborhood
Associations for the locality where the curb cut would be made, so that the association may have an opportunity for
review, prior to action by the City Council.
Please indicate by return mail your approval or disapproval of the petition within twenty-one days from the date
of this letter. If the response is "disapproval" please state reasons. Be sure to sign the form and include a daytime phone
number. I have enclosed a self-addressed stamped envelope to facilitate your reply.
As soon as this office has received both the completed application and your neighborhood association response, I
will place the petition on the agenda for the next City Council meeting. If I do not receive a response from your
neighborhood organization by twenty-one days from the date of this letter, I will place the petition on the agenda for the
next City Council meeting.
If your neighborhood association cannot complete its review by twenty-one days from today, you may extend the
reply time another seven days by requesting an extension by letter to me with a copy to the petitioner. However, I urge
you to make every effort to complete your review as soon as possible.
