BZA-167200 Case No: 309 Pearl Street Location: Sam and Scarlet Batchelor Petitioner: On April 28, 2022, Petitioner Sam Batchelor appeared before the Board of Zoning Appeal requesting a variance in order to install a driveway less than the required minimum 10 feet and park within the front setback. The Petitioner requested relief from Article 6, Sections 6.44.1a&cc and 6.43.4A, and Article 10, Section 10.30 of the Cambridge Zoning Ordinance ("Ordinance") The Petitioner submitted materials in support of the application including information about the project, plans, and photographs. Mr. Batchelor stated that the proposal was to use an existing permeable paved area as a driveway in order to have a spot to charge an electric vehicle. He stated that the house was placed in such a way, on a comer lot with two front yards, that there was no compliant spot for the driveway that would not be in the front setback. The Chair asked if anyone wished to be heard on the matter and no one indicated such. After discussion, the Chair moved that the Board make the following findings based upon the application materials submitted and all evidence before the Board and that based upon the findings the Board grant the requested relief as described in the Petitioners' submitted materials and the evidence before the Board: that the Board find that a literal enforcement of the provisions of the Ordinance would involve a substantial hardship to the Petitioner; that the Board find that the size and location of the house on the lot, which predated the existing Ordinance, limited the ability for parking spaces on the lot; that the Board find that the fact that it was a corner lot with two front yards, further encumbered the Petitioner to be able to locate a vehicle; that the Board find that the hardship owed to the shape of the land, being somewhat narrow and small in shape, and also to the structure's they're on, which greatly reduced the ability to park a vehicle on the site; that the Board find that the Petitioner wished to park the vehicle as sbown on the drawing to be able to use an electric charging station for the vehicle, which had some public benefit, that the Board find that the relief may be granted without substantial detriment to the public good: that the Board find that desirable relief could be granted without nullifying or substantially derogating from the intent and purpose of the Ordinance; that the Board find that the relief was somewhat de minimis, given the size and location of the lot and the stricture thereon. The Chair further moved that the Board specifically find that based upon all the information presented, there are circumstances involving a substantial hardship relating to this property within the meaning of M.G.L. c. 40A § 10 and that the Board grant the variance for the requested relief on the condition that the existing permeable pavers be maintained and the existing greenscape not be removed or be paved over with a non-pervious substance. The five-member Board voted unanimously in favor of the findings and of granting the variance as conditioned (Sulliven, Monteverde, Alexander, Anderson, and Leiserson). Therefore, the variance is granted as conditioned.
