The Cambridge Historical Commission hereby certifies, pursuant to the
Massachusetts Historic Districts Act (MGL Ch. 40C) and the Cambridge
Historical Buildings and Landmarks Ordinance (Cambridge City Code,
Ch. 2.78), that the work described below is not incongruous to the
historic aspects or architectural character of the building or
district:
1. Alter a portion of the brick serpentine wall to make
an opening for a driveway on the Brattle Street side
of the property, in the approximate location of an
earlier driveway.
2. Reconstruct approximately 30 feet of the wall along
the driveway and construct a paved driveway, wood
gate, and new brick wall east of the driveway.
Work is to be carried out as described in the plans by Gary
Wolf Architects titled, "17 Fresh Pond Parkway, Cambridge,
MA 02138," and dated 9/13/2022.
Approval was granted on the condition that construction
details and material samples be reviewed with and approved
by the staff of the Historical Commission.
All improvements shall be carried out as shown on the plans and
specifications submitted by the applicant, except as modified above.

time, for periods not exceeding six months each, may be allowed in
writing by the Chair.

deep concern for safety.
The intersection at Fresh Pond Parkway and Brattle is high traffic and a dangerous and unsafe
intersection. It is also an intersection where many children and young people travel during
peak hours to go to school at Shady Hill and BB&N. There have been several car accidents
there, including a recent one involving the curved wall at 17 Pond Parkway, and another on
Brattle St across the road from it.
As someone who drives in this area daily l am affected personally, but l am also concerned for
the safety of others.
In addition, as I understand it, the city is in process of adding bike lanes, which may exacerbate
the safety issues at this intersection.
The documents I received from Attorney Fawcett, though helpful in many respects, did not
address the traffic and safety issues about which I am concerned.

Hello again,
I wrote to you in July to introduce myself and to tell you how excited I am about restoring the historic
property at the corner of Brattle Street and Fresh Pond Parkway and bringing it back to life as a gracious
home for my partner, Marie Sheppard, and myself.
As mentioned, I have been working with my associates Delvin Kelly and Rhonda Davis along with
architect Gary Wolf and Cambridge attorney Deborah Fawcett to develop plans to restore the property at
17 Fresh Pond Parkway(FPP). We have also been working with engineers, arborists, and landscape
professionals and have been in contact with a variety of City officials, including Charles Sullivan and
Sarah Burks of the Cambridge Historical Commission.
Although we are still in the process of developing and refining plans for the site as a whole, we are now
ready to proceed with re-establishing the historic entrance to the property from Brattle Street. To do so,
we need to apply to the City for a curb cut permit. There are several steps in the curb cut permit review
process. We hope and expect to submit our curb cut permit application to the City's Inspectional Services
Department soon. In the meantime, we have submitted our curb cut plan to the Cambridge Historical
Commission requesting curb cut approval application for a Certificate of Appropriateness
The curb cut permit application must include specific plans for the proposed curb cut as well as Abuttors'
Forms signed by the owners of properties abutting 17 Fresh Pond Parkway indicating their approval of
the proposed curb cut. I've included with this letter a copy of the plan prepared by Gary Wolf, which
illustrates our proposed design for the curb cut and entrance to the property from Brattle Street. I hope it
meets with your approval.
I have also included a copy of the Abuttors' Form. If you do approve of the proposed curb cut, please

I am working with Dale LeFebvre in connection with his efforts to revitalize and restore the beautiful historic
property he owns at the corner of Brattle Street and Fresh Pond Parkway, behind the red brick serpentine
wall. As you know from previous correspondence, Dale is preparing to submit an application to the City for
a curb cut permit in order to re-establish an entrance to the property from Brattle Street. The permit

approval of the proposed curb cut and Brattle Street entrance. I am writing to give you an update on the

At its October 6 meeting, the Cambridge Historical Commission granted a Certificate of Appropriateness for
the proposed curb cut and entrance to the property from Brattle Street. The proposal has been supported by
a number of the property's neighbors, including Douglas Brown, one of the officers of the Fresh Pond
Residents' Alliance, who spoke in support of the application at the Commission's hearing. We hope to submit
the application for a curb cut permit to the City soon, after we have finalized the requisite engineering plans

I do have objections. The intersection is very dangerous and there have been several accidents in

I do appreciate that you have concerns. I used to live a block away on Brattle Street myself, and |
know that it is a busy intersection. I think that the primary source of the danger is not Brattle Street
itself, however, which is essentially straight and has been in that location for centuries. I think the
danger comes from Fresh Pond Parkway, which is narrow and curvy and heavily traveled, by speeding
drivers with limited ability to see ahead. As things stand now, the only way to enter or exit the property
is by a break in the brick wall on one of the dangerous curves on Fresh Pond Parkway--an undeniably
hazardous situation.
Those of us who have been working on and reviewing the project believe that adding the proposed
entrance to the property from Brattle Street will in fact lessen the hazard and will not add appreciably
to traffic congestion or safety concerns. Historically, the entrance to the property was in fact from
Brattle Street, and the property's official address was 219 Brattle Street until some time in the
twentieth century. Re-establishing a Brattle Street entrance now will make it possible to use Brattle
Street as the principal entrance to the property and to use the Fresh Pond driveway to exit the
property, which should improve safety and traffic flow. The location of the proposed entrance is almost
immediately adjacent to the existing curb cut for 215 Brattle Street; so, the new entrance should not
create a new disruption to current traffic patterns on Brattle Street.
There are many steps in the City's process of reviewing a curb cut application. The Cambridge
Historical Commission has already granted a Certificate of Apropriateness for the proposed curb cut.
The Inspectional Services Department, the Traffic, Parking and Transportation Department, the
Department of Public Works, the Fire Department, and the City Council will each review the
application, and neighborhood associations will have the opportunity to weigh in. The zoning
ordinance sets forth specific standards that must be met, including minimum distance from the
intersection and the crosswalk. These standards and the extensive review process are all intended to
ensure that safety concerns are met.

! am not aware of any City document or publication that identifies in detail the specific criteria abutters should consider
in connection with curb cut permit applications, butI have attached to this email a couple of City documents that
outline the general process and criteria employed in evaluating permit applications.
My understanding is that each of the various City Departments will analyze the application using criteria specific to
that Department's area of expertise. Neighborhood Associations also have the opportunity to review and comment on
the application. I presume they consider the proposal's effect on the neighborhood in terms of general welfare as well
as traffic and safety, which the Traffic, Parking and Transportation Department will analyze in detail. The Historical
Commission analyzes the application in terms of preserving and respecting the property's architectural and historical
context.
The Abuttor Form requirement applies to the owners of properties immediately abutting or directly across the street
from the applicant's property; I think the principal concern is what effect, if any, the proposed curb cut would have on
that particular abutting property. Because of 17 Fresh Pond Parkway's unusual size and configuration, there are
actually thirteen properties that count as abutting properties under the City's requirements, although there may not be
a direct effect on each of those properties. In this case, 215 Brattle Street is clearly the property that will be most
directly affected by the proposed curb cut. The proposed entrance to 17 Fresh Pond Parkway from Brattle Street will
be almost immediately adjacent to the curb cut and driveway of 215 Brattle Street. The owners of 215 Brattle have
enthusiastically supported the proposed curb cut.

I'm forwarding to you an email | received yesterday from Quinton Zondervan, a member of the City Council. After the
various City departments have reviewed the permit application and neighborhood associations have weighed in, the
City Council votes to approve or disapprove the application. | also communicated with Ranjit Singanayagam,
Commissioner of the Inspectional Services Department, whose role is to ensure that the proposed curb cut meets the
requirements imposed by the Zoning Ordinance. Ranjit told me that a curb cut does not usually have an effect on an
abutting property. Both Ranjit and Quinton seem to agree with my assumption, that the abutter should consider the
effect the proposed curb cut will have on the particular property owned by the abutter.
I hope this information is useful to you in considering the proposed curb cut, which I hope you will decide to support.
