Petitioner: ITA Software, Inc, c/o Vincent Panico, Esq.
On July 10, 2008, Petitioner's vice president Cara Kretz appeared before the
Board of Zoning Appeal with her attorney Vincent Panico requesting a variance in
order to install two signs on the building. The Petitioner requested relief from
Article 7, Section 7.16.22.c of the Cambridge Zoning Ordinance ("Ordinance").
The Petitioner submitted application materials including information about the
project, plans, and photographs.
Mr. Panico stated that the proposal was to erect two signs for identification
purposes and that they violated height and size. He stated that these violations
were required due to the scale and unique shape of the building. He stated that
these types of signs, with these types of violations, are common in the area.
The Chair asked if anyone wished to speak in favor of or in opposition to the
proposal, no one indicated such.
After discussion, the Chair moved that the Board grant the variance for relief in
order to install two signs on the building based on the finding that a literal
enforcement of the provisions of the Ordinance would involve a substantial
hardship to the petitioner. The Chair moved that the Board find that in order to
comply with the Ordinance, the locations of any signage would be impractical at
this particular location due to the unique size and configuration of the building.
The Chair moved that the Board find that the hardship is owing to the size of the
building and to the layout, which makes any compliant signage impractical, and to
the desire to have some recognition of the establishment. The Chair moved that
the Board find that desirable relief may be granted without substantial detriment to
the public good and that relief may be granted without nullifying or substantially
derogating from the intent and purpose of the Ordinance. The Chair moved that
the Board grant the variance on the condition that the signage be in compliance
with the plans submitted, and initialed and dated by the Chair.
The five member Board voted unanimously in favor of finding a hardship and in
granting a variance (Sullivan, Alexander, Spurlock, Hughes, and Heuer) with the
above conditions. Therefore, the variance is granted.
The Board specifically finds that, based upon all the information presented, there
are circumstances involving a substantial hardship relating to this property within
the meaning of M.G.L. c. 40A § 10. The Board also finds that desirable relief
could be granted without substantial detriment to the public good and without
nullifying or substantially derogating from the intent or purpose of the Ordinance.
The Board of Zoning Appeal is empowered to waive local zoning regulations
only. This decision therefore does not relieve the petitioner in any way from the
duty to comply with local ordinances and regulations of the other local agencies,
including, but not limited to the Historical Commission, License Commission
and/or compliance with requirements pursuant to the Building Code and other
applicable codes.
