On May 25, 2017, Petitioner Dudley Rose appeared before the Board of Zoning Appeal
with his attorney Sarah Like Rhatigan requesting a variance in order to construct a
driveway and one parking spot. The letitioner requested reliet from Article 6, Sections
6.43.4. a and 6.44 La of the Cambridge Zoning Ordinance ("Ordinance"). The Petitioner
submitted materials in support of the application including information about the project,
plans, and photographs.
Ms. Rhatigan stated that the proposal was to install a driveway to the side of the house ia
a neighborhood that was congested and where it was difficult to find street parking. She
stated that the driveway needed to be 10 feet wide, but that only 9.5 feet were available,
and so a variance was being sought. She stated that the hardship related to the small and
narrow lot. She stated that there was no street parking on the side of the street where the.
driveway would be installed, so that no public space would be lost. She stated that the
neighbors had similar preexisting nonconforming driveways and that they supported the
proposal. She stated that there would be no room for tandem parking in the proposed
driveway.
• Neighbors spoke and/or wrote it support of the proposal. One neighbor wrote in
opposition to the proposal.
After discussion, the Chair moved that the Board make the following findings based upon
the application materials submitted and all evidence before the Board and that based upon
the findings the Board grant the requested relief as described in the Petitioner's submitted
materials and the evidence before the Board: that the Board find that a literal enforcement
on the provisions of the Ordinance would involve a substantial hardship, in that the
neighborhood was congested and parking was a problem; that the Board tind that the..
nardstup owed to the noncontorming structure in a tight neighborhood, where any
driveway construction would require relief from the Board, that the Board find that
desirable relief could be granted without substantial detriment to the public good or
nullifying or substantially derogating from the intent and purpose of the Ordinance; and
that the Board find that off street parking was prohibited on the side of the street where
the driveway was proposed and so would not take away from public street parking.
The Chair further moved that the Board specifically find that based upon all the
information presented, there are circumstances involving a substantial hardship
relating to this property within the meaning of M.G.L.. c. 40A § 10 and that the
Board grant the variance for the requested relief on the following conditions:
1 that the driveway be constructed consistent with the plan submitted, as
initialed by the Chair at the hearing of May 25, 2017, and
2 that the driveway only be used, at least on a regular basis, for one car and
that the car not park in the front yard, such that the car would need to be
pulled up the driveway.
The five member Board voted unanimously in favor of the findings and of granting the
variatice as conditioned (Alexander, Sullivan, Green, Tedesco, and Best). Therefore, the
variance is granted as conditioned.
The Board of Zoning Appeal is empowered to waive local zoning regulations only. This
decision theretore does not relieve the petitioner in any way from the duty to comply with
local ordinances and regulations of the other local agencies, including, but not limited to
the Historical Commission, License Commission and/or compliance with requirements
pursuant to the Building Code and other applicable codes.

curb cut at the premises numbered 15 Line Street, Cambridge, Massachusetts. The City Council has directed that
all curb cut petitions be submitted to the appropriate Neighborhood Associations for the locality where the curt cut
would be made, so that the association may have an opportunity for review, prior to action by the City Council.
Please indicate by return mail your approval or disapproval of the petition within twenty-one days from the
date of this letter. If the response is "disapproval" please state reasons. Be sure to sign the form and include a
daytime phone number. I have enclosed a self-addressed stamped envelope to facilitate your reply.
As soon as this office has received both the completed application and your neighborhood association
response, 1 will place the petition on the agenda for the next City Council meeting. If I do not receive a response
