Members of the Board of Zoning Appeal heard testimony and viewed materials submitted
regarding the above request for relief from the requirements of the Cambridge Zoning Ordinance.
The Board is familiar with the location of the petitioner's property, the layout and other
characteristics as well as the surrounding district.

On November 18, 2004, Petitioner's agent James Wagner appeared before the
Board of Zoning Appeal requesting a variance to install two pin letter wall signs,
one projecting sign, and two banners with text. The Petitioner submitted plans and
photographs.
This case had been continued from October 7, 2004, to allow the Petitioner an
opportunity to provide more adequate plans and descriptions of mounting
techniques. At this meeting, the Chair read the following from the Cambridge
Historical Commission: "Pending reviews of designated properties for public
meeting to be held on Thursday, October 7th, 2004, regarding Case No. 8956 at 689
Mass. Ave., the property is located in the Central Square National Registry District.
It is the staff's recommendation that the sign be modified so as not to obscure
original details on the building, and that the signage be attached in a manner that is
reversible, and using the least destructive methods possible."
At the November hearing, the Chair noted a letter from the Planning Board
objecting to the proposal overall and identifying problems with the number of
signs, the banners, and internal illumination.
Mr. Wagner stated that the bank had changed hands and was being re-signed. He
said that the proposed signs violated one or more of the height, area, or
illumination requirements. He stated that this level of signage was required due to
the building's architecture, street location, and night hours. He stated that the
signs would be installed with as little damage to the building as possible.
The Chair asked if anyone wished to be heard on the matter, no one indicated
such.
After discussion, the Chair moved that the Board find a hardship at 689 Mass Ave
that would warrant the installation of a projecting sign, which is internally
illuminated, with some variance from height and internal illumination
requirements.
The five member Board voted unanimously against the finding (Sieniewicz, Pinck,
Sullivan, Hughes, and Griffin).
The Chair moved, therefore, that the Board deny the variance request for the
projecting, internally illuminated, sign.
The five member Board voted unanimously in favor of denying the variance
(Sieniewicz, Pinck, Sullivan, Hughes, and Griffin). Therefore, the variance for the
projecting sign is denied.
The Chair moved that the Board find a hardship at 689 Mass Ave that warrants
relief for two Citizens green banners with white copy, measuring 216"x28" and
being 20'8" from grade. The Chair moved that, based on that finding, the Board
grant the variarice from those two signs on the condition that they be installed
consistently with drawings submitted in support of this application using the
brackets that already exist on the building.
The five member Board voted unanimously in favor of granting the variance
(Sleniewicz, pinck, Sullivan, Hughes, and Grittin) With the above conditions.
Therefore, the variance fot the banners is granted.
The Chair moved that the Board find that a hardship exists at the site that warrants
rellet trom the height and area restrictions of the Ordinance for a new green pin
letter sign above the door, 6" letter height, 10" logo height, with a 5'6 dimension
overall, which is in excess of 20' from grade. The Chair moved that the Board
grant the variance on the condition that the work be consistent with drawings
submitted in support of this application.
The five member Board voted unanimously in favor of granting the variance
(Sieniewicz, Pinck, Sullivan, Hughes, and Griffin) with the above conditions.
Therefore, the variance for the smaller pin letter sign is granted.
The Chair moved that a hardship be found at 689 Mass Ave, that warrants the
installation of new green pin letter signs on the building parapet, 24" high, with a
logo of 24", with an overall length of 20'9" as depicted in drawings submitted in
support of the application with a height of 55' above grade, requiring relief from
both the area and the height restrictions for signs at the location. The Chair moved
that the Board grant the variance on the condition that the sign be installed
consistent with drawings submitted in support of this application.
The five member Board voted three in favor of granting the variance (Sieniewicz,
Hughes, and Griffin) and two opposed (Pinck and Sullivan). Therefore, the
variance for the larger pin letter sign is denied.
The Board specifically finds that there are circumstances involving a substantial
hardship relating to this property within the meaning of M.G.L. c. 40A § 10. The
Board also finds that desirable relief could be granted without substantial
detriment to the public good and without nullifying or substantially derogating
from the intent or purpose of the Ordinance.
The Board of Zoning Appeal is empowered to waive local zoning regulations
only. This decision therefore does not relieve the petitioner in any way from the
duty to comply with local ordinances and regulation of the other local agencies,
including, but not limited to the Historical Commission, License Commission
and/or compliance with requirements pursuant to the Building Code and other
applicable codes.
