H 3998 118 Chapter Of the Acts of 2019 COMMONWEALTH OF MASSACHUSETTS THE In the One Hundred and Ninety-First General Court AN ACT FURTHER REGULATING THE FAIR HOUSING ORDINANCE OF THE CITY OF CAMBRIDGE. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: Section I of chapter 413 of the acts of 1991 is hereby SECTION 1. amended by inserting after the figure "1991", in line 18, the following words: - , as amended. SECTION 2. Said section 1 of said chapter 413 is hereby further amended by striking out, in line 57, the word "handicaps" and inserting in place thereof the following word: - disabilities. SECTION 3. Said section 1 of said chapter 413 is hereby further amended by inserting after the word "orientation", in line 70, the following words: - , gender identity. SECTION 4. Section 14.04.030 of said section 1 of said chapter 413 is hereby further amended by striking out paragraph 6 and inserting in place thereof the following paragraph: - 6. The term "disability" shall mean a physical or mental impairment that substantially limits at least 1 of a person's major life activities, a record of having such impairment or being regarded as having such impairment. This term shall not include current, illegal use of or addiction to a controlled substance as defined in section 102 of the Controlled Substances Act. SECTION 5. Said section 1 of said chapter 413 is hereby further amended by inserting after the word "orientation", in line 81, the following words: - , gender identity. SECTION 6. Said section 14.04.030 of section 1 of said chapter 413 is hereby further amended by striking out paragraph 11 and inserting in place thereof the following paragraph:- 11. The term "gender identity" shall mean a person's gender-related identity, appearance or behavior, whether or not that gender-related identity, appearance or behavior is different from that traditionally associated with the person's physiology or assigned sex at birth. SECTION 7. Said section 1 of said chapter 413 is hereby further amended by inserting after the word "orientation", in line 154, the following words:- , gender identity.

Said section 1 of said chapter 413 is hereby further amended striking out, in lines 226 and 227, the words "handicapped person" and inserting in place thereof the following words: - person with a disability. SECTION 18. Said section 1 of said chapter 413 is hereby further amended by striking out, in line 236, the words "handicapped persons" and inserting in place thereof the following words: - persons with a disability. SECTION 19. Said section 1 of said chapter 413 is hereby further amended by striking out, in line 238, the words "handicapped persons" and inserting in place thereof the following words: - persons with a disability. SECTION 20. Said section 1 of said chapter 413 is hereby further amended by striking out, in lines 245 and 246, the words "Buildings and Facilities providing Accessibility and Usability for Physically Handicapped people ("ANSI A117.1") " and inserting in place thereof the following words: - Accessible and Usable Buildings and Facilities ("ANSI's ICC A117.1-2017").

Said section 1 of said chapter 413 is hereby further amended by striking out, in lines 261 and 263, the words "the handicapped", each time they appear, and inserting in place thereof, in each instance, the following words: - persons with disabilities. SECTION 22. Said section 1 of said chapter 413 is hereby further amended by inserting after the word "orientation", in line 265, the following words: - • gender identity. SECTION 23. Said section 1 of said chapter 413 is hereby further amended by striking out, in line 267, the words "the handicapped" and inserting in place thereof, in each instance, the following words:- persons with disabilities.
